¶1 This action concerns a dispute over a real estate broker's commission. The seller, Luke Sims, seeks recovery of $20,000 in earnest money retained by Stapleton Realty, Ltd. following the sale of his residence. Stapleton Realty counterclaimed asserting that the $20,000 is a portion of the commission owed to it by Sims and seeking the full commission. The circuit court granted summary judgment in favor of Sims, concluding that the listing contract was void because of noncompliance with WIS. STAT.§ 240.10(1) (2005-06)*fn1 and that Stapleton Realty had not fulfilled the contract term of obtaining an offer from the listed parties.
